What do I do if I have been involved in an accident? |
 |
Make sure that you have the contact details of any witnesses and record as much information as you can about your accident. If you have fallen, take a photograph of the defect that caused you to fall.
Make sure that your accident is recorded.
Write down the insurance details of the other parties involved in the accident and keep a record of any accident reference number. If the police attended your accident, write down the Police officers details.
It is important that you seek medical attention. Sometimes the trauma of an accident can mask the pain of some injuries, for example whiplash – an injury to the neck. Visit either your local GP or hospital as soon as possible following your accident. |

Will I have to go to court? |
 |
Court proceedings are necessary if there is a dispute over whose fault the accident is that needs to be resolved or if the value of the claim can not be agreed. Even if court proceedings need to be taken, the majority of cases are settled before a hearing is reached. |

How much is my claim worth? |
 |
Each case is different – this is because injuries differ. Compensation claims are in two parts: injury and financial loss. Awards vary from a thousand pounds or less, in smaller cases, to multi million pound awards in substantial serious injury cases. |

If it is a straight forward case, six to twelve months. More complicated cases or cases where there are disputes can take longer. Much depends upon the exact circumstances of the case. |

If there are no court proceedings, you will not have to pay your opponents costs. If there are court proceedings and you lose, then you may be ordered to pay your opponents costs.
